Terms of Service

1. About these terms

These Terms of Service ("Terms") form a binding agreement between you and ToggleKit Ltd, a company registered in England and Wales ("A11yFlow", "we", "us", "our"). By creating an account, generating an API key, or otherwise using the A11yFlow API, dashboard, or documentation (together, the "Service"), you confirm that you have read, understood, and agree to these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. In that case, "you" refers to the entity you represent.

2. The Service

A11yFlow provides an automated web accessibility scanning API. The Service analyses publicly accessible web pages against the Web Content Accessibility Guidelines (WCAG) 2.2 and returns structured results including violation details, severity ratings, guideline mappings, and suggested remediation steps.

The Service is a technical tool intended to assist developers and organisations in identifying potential accessibility issues. It does not provide legal advice, and a scan result — whether a pass or a fail — does not constitute a legal opinion on your compliance with the Equality Act 2010, the European Accessibility Act, or any other legislation.

3. Accounts and API keys

You must create an account to use the Service. You are responsible for keeping your login credentials and API keys confidential. API keys should never be committed to public repositories, embedded in client-side code, or shared with unauthorised parties.

You are responsible for all activity that occurs under your account or through your API keys, whether or not you authorised that activity. If you become aware of any unauthorised use, you must notify us immediately via our contact form and revoke the compromised key.

4. Acceptable use

You agree that you will:

  • Only scan websites that you own or for which you have obtained explicit, written permission from the owner.
  • Comply with all applicable laws, including data protection legislation, when using the Service.
  • Respect the rate limits and scan quotas associated with your subscription tier.

You agree that you will not:

  • Use the Service to conduct denial-of-service attacks, load testing, or any activity intended to disrupt a third-party website or service.
  • Attempt to scan internal, private, or non-publicly-accessible URLs through the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicence, or redistribute access to the Service without our prior written consent.
  • Use the Service in any way that could damage our reputation or the reputation of A11yFlow.

We reserve the right to suspend or terminate your access immediately if we reasonably believe you are in breach of this section.

5. Subscriptions and payment

The Service is available on a free tier and on paid subscription plans. Paid plans are billed monthly. All payment processing is handled by Paddle.com Market Limited ("Paddle"), who acts as our Merchant of Record. Paddle is responsible for the calculation, collection, and remittance of VAT, sales tax, and other transaction taxes. By subscribing to a paid plan, you also agree to Paddle's Terms of Use.

  • Plan upgrades take effect immediately. You will be charged a prorated amount for the remainder of the current billing period.
  • Plan downgrades take effect at the end of the current billing period. You will retain access to the higher-tier features until that date.
  • You may cancel your subscription at any time through the billing page. Cancellation takes effect at the end of the current paid period, and no further charges will be made.
  • Refund requests are considered on a case-by-case basis. Please contact us within 14 days of the charge.

6. Intellectual property

All rights, title, and interest in the Service — including its software, design, documentation, trademarks, and any other materials — remain the property of ToggleKit Ltd. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

Scan results generated through your use of the API belong to you. We claim no ownership over the output data produced by the Service in response to your requests.

7. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing:

  • We do not warrant that scan results are complete, accurate, or free from error. Automated scanning tools have inherent limitations and cannot detect all accessibility barriers.
  • A passing scan result does not mean that a website is fully accessible or compliant with any particular legal standard.
  • The Service does not constitute legal, regulatory, or professional advice. You should seek independent legal counsel if you require advice on accessibility compliance obligations.
  • We do not guarantee uninterrupted or error-free operation of the Service.

8. Limitation of liability

To the maximum extent permitted by the laws of England and Wales:

  • A11yFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunity, or reputational damage, however caused and under any theory of liability.
  • Our total aggregate liability to you for any and all claims arising out of or in connection with the Service shall not exceed the greater of (a) the total fees paid by you to A11yFlow in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of England and Wales.

9. Indemnification

You agree to indemnify and hold harmless ToggleKit Ltd, its directors, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your breach of these Terms; or (c) your violation of any applicable law or the rights of any third party.

10. Suspension and termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Where reasonably practicable, we will give you advance notice.

You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 6 through 9 and 12 through 14 survive termination.

11. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the dashboard at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes.

12. Force majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or third-party service provider outages.

13. General provisions

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and A11yFlow with respect to the Service and supersede all prior agreements and understandings.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
